Conditions for participation in the Sweepstake of NFL and Bundesliga tickets

Void where prohibited.

1. Sweepstake

1.1 DFL Deutsche Fußball Liga GmbH, Guiollettstraße 44-46, 60325 Frankfurt/Main, Germany, ("Organizer" or "we"), with the support of the National Football League ("NFL"), will conduct a sweepstake on the occasion of the NFL games in Germany 2023 ("Sweepstake") among all those who have created a Bundesliga account via the offered registration option on our official website www.bundesliga.com ("Website") or in the official Bundesliga app by the end of the entry period on 10.10.2023 at 23:59 (CEST). Participation in the sweepstake and its implementation are governed by the following conditions ("Conditions of Participation"). By entering or participating in the Contest, participants agree to these Terms and Conditions and recognize them as binding.

1.2 A Bundesliga account shall be deemed to have been created if the participant has registered within the participation period specified in Section 1.1 and has confirmed this by means of a so-called double opt-in. The participant is solely responsible for the timeliness of the registration and the correctness of his/her entries. Registrations received after the closing date will not be considered.

1.3 Participants who have completed registration of a Bundesliga account by the end of the participation period and are eligible to participate and win in accordance with section 2 will be entered into a draw for the following total of 10 prizes.

• 1st prize (grand prize): a “Week of Football”-package, consisting of:
  • 2 tickets to “the Klassiker” Borussia Dortmund vs FC Bayern Munich between 03.11.2023 and 05.11.2023 in Dortmund, Germany, (normal ticket category).
  • 2 tickets to the NFL game Miami Dolphins vs Kansas City Chiefs on 05.11.2023 in Frankfurt, Germany, (normal ticket category)
  • travel from a major airport (or, if the winner and his/her accompanying person travel by train: major train station) near the winner's residence to Dortmund, accommodation in a hotel for the winner and his/her accompanying person 2 nights (from 03.11.2023 to 05.11.2023) in Dortmund and accommodation in a hotel for 1 night from 05.11.2023 to 06.11.2023 in Frankfurt and appropriate meals, as well as local transport and in Germany to/from the airport (or, if the winner and his/her accompanying person travel by train: train station), to the hotels, to Dortmund and Frankfurt and in other activities organized by us around the games. (Total value of the prize: aprox. EUR 4,800.00).
• 2nd – 5th prize: 2 tickets each to the NFL game Miami Dolphins vs. Kansas City Chiefs on 05.11.2023 in Frankfurt, Germany, (normal ticket category; all further costs, e. g. for meals, travel to and from the game, etc. are not included in the prize and are to be covered and organized by the respective winner);
• 6th – 10th prize:  2 tickets each to the NFL game Indianapolis Colts vs. New England Patriots on 12.11.2023 in Frankfurt, Germany, (normal ticket category; all further costs, e. g. for meals, travel to and from the game, etc. are not included in the prize and are to be covered and organized by the respective winner).

1.4 The grand prize winner's trip must begin and end at the same major airport (or if the winner and his/her accompanying person travel by train: at the same major train station). The grand prize winner and his/her accompanying person are solely responsible for the cost and safety of transportation to/from the airport (or, if the grand prize winner his/her accompanying person travel by train: train station) at the point of origin. The choice of airline/railway company is solely at our discretion. After the tickets are issued, the grand prize winner his/her accompanying person will be required to pay any rebooking fee if he/she wishes to change the flight/train or travel dates.

1.5 All other expenses and additional costs not expressly stated in these Conditions of Participation shall be covered by the respective winner and – in case of the grand prize winner – by his/her accompanying person. In the case of the grand prize in particular, but not limited to local transport and to/from major airport (or, if the winner and his/her accompanying person travels by train, major train station) near the winner's residence, telephone/internet, additional meals, room service charges, parking fees, insurance, visas and gratuities, and individual expenses for tobacco, alcohol, clothing, gifts or similar items that are not part of the prize redemption.

1.6 The respective winner and - in case of the grand prize winner - his/her accompanying person are solely responsible for ensuring that he/she is in possession of the required travel documents (e.g. passport, visa, etc.).

1.7 Possible taxes and fees related to the prize will be covered by the respective winner.

2. eligibility to participate and win

2.1 Only natural persons who are at least 18 years of age are entitled to participate in the sweepstake.

2.2 Participation in the sweepstake is free of charge.

2.3 Untrue personal information provided by the participant entitles us to exclude him/her from the sweepstake.

Participants who secure an unlawful advantage over other participants through manipulation, or whose entries contain immoral, defamatory, discriminatory, offensive or other unlawful material, show illegal activities or call for such activities, will also be excluded from the sweepstake. Automatic computer-generated entries and multiple entries under different email addresses are not permitted and will be disregarded.

Excluded from participation are employees of the organizer and the NFL, the companies affiliated with them pursuant to §§ 15 et seq. AktG and the DFL Foundation as well as employees of licensees, partners and sponsors of the organizer and the NFL, their affiliated companies pursuant to §§ 15 et seq. AktG and the DFL Foundation. The respective relatives of these employees are also included in the exclusion.

Any prize already distributed may be reclaimed by us in all of the aforementioned cases.

2.4 An alternative winner will be determined by conducting a new draw excluding the original winner in the following cases: (i) the relevant winner has not reached the age of 18, (ii) we claim back a prize already distributed in accordance with Clause 2.3, (iii) the relevant winner does not contact us within the time period set out in Clause 3.2 (iv) the relevant winner provides untrue personal information, or (v) the relevant winner or - in case of the grand prize winner -  his/her accompanying person is not in possession of the required travel documents (e.g. passport, visa, etc.) in due time.

3. notification of winnings

3.1 The prizes are limited to one prize per winner.

3.2 The winner will be determined and notified by email by 14.10.2023. The winner in question is obliged to get back to us by e-mail within one week after sending this notification. Should the winner fail to do so, his/her claim to the prize will lapse in full. In this case, we will determine another winner in accordance with section 2.4 to the exclusion of the relevant original winner.

3.3 The claim of the respective winner is not transferable. A cash payment or payment in kind is excluded.

3.4 The claim to the prizes will be forfeited if the winnings are not redeemed by the respective game for reasons that are solely the responsibility of a winner (e.g. no game attendance possible due to illness).

3.5 Winning tickets entitles the winner and his/her accompanying person exclusively to their private, non-commercial use; any commercial or business resale and any other unauthorized transfer or offering of tickets by the winner concerned is prohibited. In particular, he/she is prohibited from offering and/or selling and/or passing on the tickets publicly, in particular at auctions or on the Internet (e.g. on Ebay, Ebay classifieds, Facebook) and/or on sales platforms not authorized by the Club or the NFL (e.g. viagogo, seat-wave, StubHub), or passing them on to persons who are banned from attending stadiums or who have been banned from attending sporting events in the last five years for security reasons.

3.6 Further costs, in particular due to non-delivery of a prize to the address named by the respective winner, will not be covered by us.

3.7 Possible taxes and fees in connection with a prize must be covered by the respective winner.

4. data protection

4.1 If there is any suspicion that the tickets have been resold, in particular by the winner, contrary to section 3.5, we may transmit the name and contact details of the winner concerned to the BVB, so that it can take sanction measures against the winner. The legal basis for the transmission is the legitimate interest (Art. 6 (1) sentence 1 f) of the European Data Protection Regulation "DSGVO") of the organizer, the NFL and the BVB to prevent the unauthorized ticket resale.

4.2 We comply with all legal requirements regarding data protection and data security. All personal data of the participant in connection with the sweepstake will only be collected, stored and processed for the purpose of conducting the sweepstake and subsequently deleted, unless we are legally obligated or entitled to further storage.

4.3 The collection, storage and processing of personal data of the participant (including their deletion and retention periods) in connection with the registration of a Bundesliga account and any additional newsletter registration associated therewith shall in turn be determined conclusively in accordance with the terms of use for services and the privacy statement applicable thereto.

4.4 The responsible party for the processing of personal data in accordance with these Terms and Conditions of Participation is the Organizer. 5. warranty and liability

The following provisions shall apply to our warranty and liability for the sweepstake provided free of charge, irrespective of the legal grounds:

5.1 In the event of a slightly negligent breach of cardinal obligations (i.e. essential contractual obligations which must be fulfilled by us and which are essential for the achievement of the purpose of the sweepstake or which must be observed by us and the breach of which may jeopardize the achievement of the purpose of the contract), our liability shall be limited in amount to the damage typically foreseeable at the time of conclusion of the contract. We shall not be liable for the slightly negligent breach of other obligations.

5.2 We do not assume any warranty for material defects and/or defects of title in the prizes. The winner can only assert warranty claims against the respective supplier. If the prize or part of the prize is provided by a partner, we shall also not be liable for any insolvency of this partner and the consequences of his insolvency. The exclusion of the above liability for material defects and/or defects of title on our part shall not apply if the material defect or defect of title was maliciously concealed by us.

5.3 The above limitations and exclusions of liability shall not apply in cases where liability is mandatory by law, in particular in the event of culpable injury to life, body and health or in the event of claims under the Act on Liability for Defective Products. Insofar as our liability is excluded or limited, this shall also apply to the personal liability of our executive bodies, employees, representatives and vicarious agents.

6. other provisions

6.1 We reserve the right to cancel or discontinue the sweepstake at any time and without giving reasons. In particular, technical and/or legal reasons due to which the sweepstake can no longer be carried out properly and professionally may form the basis for the termination.

6.2 Legal recourse is excluded. Only the law of the Federal Republic of Germany shall apply.

6.3 The place of performance of the sweepstake is the registered office of the organizer.
