Terms and Conditions for Participating in the Competition for the Voting for the “Team of the Season 2023/2024”

No purchase or payment of any kind is necessary to enter or win. A purchase will not improve the chances of winning. Void where prohibited.

1. Competition

1.1 DFL Deutsche Fußball Liga GmbH, Guiollettstrasse 44-46, 60325 Frankfurt/Main, Germany, ("DFL" or “We”) conducts an online competition in connection with voting for the Team of the Season 2023/2024 on the Bundesliga’s German- and English-language official account at the social media platform X (@Bundesliga_DE, @Bundesliga_EN) and the Bundesliga’s English-language official account at the social media platform Instagram (Bundesliga) ("Competition"). Participation in the Competition and how it is conducted are governed by these Terms and Conditions ("Ts&Cs"), which the participant ("Participant") recognizes as binding by participating in the Competition.

1.2 The Competition will be conducted from 17 April 2023 until 23:59 (CEST) on 21 April 2024. Any entries for the Competition received after the close for participation will not be considered.

1.3 All users which participate in the voting on ea.com, post their “Team of the Season” as a picture on their own X or Instagram profile, tag the official Bundesliga account on X or Instagram and use the hashtag #BLTOTS will go into the draw to win one of the following 25 prizes:

·       18 x 1 signed jersey of the favorite Bundesliga club* of the respective winner

* DFL will give its best effort to realize the choice of the respective winner (Bundesliga club, size). However, there is no claim for the signed jersey of a certain Bundesliga club and/or a jersey in a certain size. The final choice is based on the availability of the jersey.

·       5 x 1 Bundesliga merchandising fan package

2. Authorization to participate and win

2.1 Only individuals who have reached the age of 16 years are entitled to participate in the Competition.

2.2 Participation in the Competition is free of charge.

2.3 The Participant is responsible for the observation of X’s and Instagram’s guidelines and rules which are applicable on the Participant. The Participant indemnifies X and Instagram from claims arising from participation in the Competition.

2.4 Any false or fake personal information provided by the Participant authorizes Us to exclude him or her from the Competition.

Participants who secure an illegal advantage over other Participants, or whose entries contain immoral, slanderous, discriminatory, disgusting or other illegal material, or which show or call for illegal activities, or appear to conflict with the respective social media service’s terms of use will also be excluded from the Competition. Automatic computer-generated entries and multiple entries entries with more than one social media profile are not permissible and will not be considered in the draw. Multiple entries with the same social media profile are permitted.

Our Employees, the employees of companies affiliated with Us within the meaning of §§ 15 et seq. German Stock Corporations Act (Aktiengesetz, "AktG") and DFL Foundation, employees of Our licensees, partners and sponsors, contractual partners and of those of companies affiliated with Us within the meaning of §§ 15 et seq. German Stock Corporations Act (Aktiengesetz, "AktG") and DFL Foundation are excluded from participation. The respective relatives of all these employees are also excluded from participation.

We can demand return of a prize that has already been granted in all the above-mentioned situations.

2.4 An alternate winner will be determined by conducting a new draw excluding the respective original winner in the following cases: (i) the respective winner has not reached the age of 16 years, (ii) We reclaim a prize already distributed in accordance with Clause 2.4, (iii) the respective winner fails to contact Us within the period specified in Clause 3.2 and/or (iv) the respective winner provides false or fake personal information.

3. Prize notification

3.1 Prizes are limited to one prize per winner.

3.2 The winners will be drawn until 30 May 2024 and notified by direct message via X or Instagram. The respective winner is obliged to contact Us within two weeks after sending this notification. If a winner fails to do so, the respective prize will be forfeited and an alternate winner will be selected at Our sole discretion by conducting another draw excluding the respective original winner.

3.3 The claim for the respective prize is not transferrable. A cash payout or payout with physical items is excluded.

3.4 We will not bear any further costs, in particular due to the non-delivery of a prize to the address named by the respective winner.

3.5 Possible taxes and fees in connection with a prize must be borne the respective winner.

4. Data privacy

4.1 In the event that it is necessary to redeem a prize, We will ask the respective winner for additional contact information (e.g. postal address). If a prize or part of a prize is redeemed through retailers or other providers, We are entitled to share the contact data of the respective winner with the respective retailer or provider so that they can contact the respective winner. The legal basis for processing is Art. 6 para. 1 sentence 1 b) of the the European General Data Protection Regulation (“GDPR”).

4.2 We will observe all legal provisions on data protection and data safety. All personal data of the Participant will be solely collected, processed and stored for the conduction of the Competition and deleted afterwards, unless We are legally required or entitled to further store the respective personal data.

4.3 The controller of personal data processed according to these Ts&Cs is the DFL. The further data protection provisions including the rights of the Participants under the GDPR and the contact data of Our data privacy officer can be found in the Privacy Statement under the following link.

5. Other provisions

5.1 We reserve the right to interrupt or shut down the Competition at any time without stating reasons. Especially reasons involving technology and/or legal matters, as a result of which the Competition can no longer be properly conducted, can be the basis for the end of the Competition.

5.2 The Competition is not connected to X and Instagram and is not sponsored, supported or organized in any way by X or Instagram. X and Instagram are not the contact person for the Competition. Questions regarding the Competition have only be addressed to Us at info@bundesliga.com 

5.3 Legal recourse is excluded. Only the law of the Federal Republic of Germany applies.

5.4 Place of performance for the Competition is Frankfurt am Main, Germany.
